In September 2025, an Independent International
Commission of Inquiry reporting to the United Nations Human Rights Council
released a legal analysis concluding that Israel’s conduct in Gaza meets the
definition of genocide under the 1948 Genocide Convention. This determination
was based on extensive documentation of events spanning nearly two years of
war, including military operations, humanitarian restrictions, and official
state conduct.
The Commission found that Palestinians in Gaza were
subjected to multiple acts prohibited under the Convention, including mass
killing, serious bodily and mental harm, and the deliberate imposition of
conditions of life calculated to bring about physical destruction. These
conditions included the systematic destruction of civilian infrastructure,
obstruction of humanitarian aid, collapse of healthcare systems, and the
creation of famine-like conditions affecting the entire population.
Central to the report was its conclusion that
genocidal intent was present. The Commission cited repeated dehumanizing and
eliminationist statements by senior Israeli officials, combined with
consistent patterns of military and policy decisions, as evidence that the
destruction of Palestinian life in Gaza was not incidental or accidental, but
foreseeable and pursued despite clear warnings of catastrophic civilian harm.
Although several governments rejected the findings,
often without directly addressing the legal analysis, the report marked a
turning point in international discourse. Claims of a “Palestinian genocide”
were no longer limited to activists, journalists, or civil society groups, but
formally articulated in a UN legal framework.
The report leaves the international community facing
a fundamental question: whether international law applies equally to all
states, or only to those without power or protection. The Commission concluded
that the evidence is sufficient, and the remaining question is enforcement.
